People with Disabilities Face Persistent Challenges in Seeking Justice

People with disabilities are being denied justice within Ireland’s legal system, as they encounter “barrier layered upon barrier” of obstacles in their efforts to access their rights, according to new research.

Published to coincide with the International Day of Persons with Disabilities, the University of Galway’s study revealed that the legal system leaves disabled individuals unsupported, confronted with confusing procedures, and lacking sufficient legal representation.

The report, released by the Irish Human Rights and Equality Commission (IHREC), offers recommendations for improvement, describing the findings as “deeply concerning.”

The report highlighted that systemic biases in the justice system are evident in the discriminatory use of mental health history during legal proceedings.

Participants also pointed out the significant gap in legal services for individuals living in residential disability facilities. These issues are further compounded for disabled individuals from marginalized groups, including migrants and members of the Traveller community.

The study additionally uncovered an unmet demand for legal support, coupled with insufficient legal aid and advocacy for people with disabilities.

The researchers, led by Dr. Charles O’Mahony, proposed several recommendations, including expanding legal aid and outreach services, providing training for justice system staff, and promoting greater diversity within the legal professions and judiciary.

Implementing these recommendations will require coordinated efforts from various agencies, such as the Department of Justice, An Garda Síochána, the Courts Service, the Probation Service, and the Irish Prison Service, according to the report.

IHREC’s Chief Commissioner, Liam Herrick, emphasized that the UN Convention on the Rights of Persons with Disabilities obligates the State to ensure that disabled individuals have effective access to justice.

“This study underscores the significant progress Ireland must make to guarantee equal access to justice for all,” he stated.
